Cannabis Enforcement Bill Signed

SACRAMENTO, CA (MPG) - Gov. Gavin Newsom has signed legislation by Assembly Majority Leader Cecilia Aguiar-Curry aimed at closing enforcement gaps in California's cannabis and hemp laws.

Assembly Bill 2250 makes changes to state law governing the classification and enforcement of certain cannabis and hemp products. The legislation also clarifies the California Department of Tax and Fee Administration's authority to seize illicit cannabis and hemp products.

"California has worked hard to build a cannabis and hemp system that protects consumers and gives legitimate businesses a fair shot," Aguiar-Curry said. "AB 2250 is about making sure those rules work the way they're supposed to."

The legislation makes technical changes to Assembly Bill 8, which Aguiar-Curry authored and became law in 2025. According to Aguiar-Curry's office, AB 2250 addresses enforcement gaps and clarifies how certain cannabis and hemp products are classified without changing the primary policies established under AB 8.

AB 2250 maintains the state's existing prohibition on inhalable hemp THC products and does not authorize or expand the use of hemp-derived THC in cannabis products.

Under California law, intoxicating THC is regulated as cannabis regardless of its source and must comply with applicable cannabis regulations.

Aguiar-Curry, D-Winters, said the changes also provide state agencies with clearer enforcement authority while giving businesses operating in the regulated market more certainty about the rules.

"We're closing a few gaps, giving state agencies the tools they need to do their jobs, and making the rules clearer for businesses doing things the right way," Aguiar-Curry said. "And we need to keep our laws tight so bad actors can't use loopholes to sell intoxicating products to consumers, especially our kids."

Aguiar-Curry said the legislation focuses on making the state's existing regulatory structure easier to enforce.

"Good policy depends on clear and enforceable laws," Aguiar-Curry said. "With AB 2250, we are making sure California's cannabis and hemp regulations are workable, consistent, and capable of protecting consumers and the integrity of our legal marketplace."
