A not guilty plea was submitted by Grady Davis, Attorney for Garrett Rudd at an arraignment held October 17 at Butte County Superior Court. Rudd is currently out on $300,00 bail after allegedly shooting two Gridley men Saturday, September 28, 2013.
The Butte County Sheriff's Department received a 9-1-1 call at 10:23 p.m., from an adult male who claimed he had just shot someone in self defense. A separate 9-1-1 call was transferred to the Sheriff's Department from the Gridley-Biggs Police Department from a male subject who told dispatchers that he and another male adult subject had been shot on Alexander Road near East Evans Reimer Road.
Upon arrival, deputies found Eric Waller and his nephew, Chase Waller who had both been shot in the back. Both men were treated at the scene and transported to Enloe Medical Center and have since been released.
A short time later, deputies located Rudd near the scene at River Avenue who was detained without incident.
Deputies recovered the firearm used along with several magazines of ammunition in his vehicle.
After a preliminary investigation, Rudd was arrested and booked into Butte County Jail on two counts of Assault with a Deadly Weapon with enhancements.
During Rudd's first court appearance the Butte County District Attorney's office requested that bail stipulations of no weapons and no contact with the victims be included on record along with an 8 p.m., curfew.
The Waller family was granted a temporary restraining order against Rudd on October 3, 2013.
A Preliminary Hearing is set for November 25, 2013 at 8:30 a.m.
