Judge Kristen Lucena denied a request for Garrett Rudd to be released on his own recognizance in Butte County Superior Court Tuesday and increased his bail from $200,000 to $300,000. Rudd's attorney, Grady Davis, told the judge that both Rudd's family and the victim's families are long-time farming families, born and raised in the area with strong ties. "The victims families and Mr. Rudd's family have known each other for many years. A bail bondsman is ready to place an ankle monitor on Mr. Rudd with a restraining order as part of condition of bail with a curfew," Davis explained. Butte County Deputy District Attorney David Garner told Judge Lucena that he recommended the increase in bail due to elevated charges from a 245 to a 245(e) because a semi automatic handgun was used. Besides two counts of Assault with a Deadly Weapon, Rudd is being charged with four enhancements – two counts for personal use of a firearm and two counts of great bodily injury. Davis had asked that the bail be reduced to $150,000 but Garner told the judge he had seen the photos and that Rudd had inflicted tremendous injury to the two men and that it was up to other people to aid the men to get them to the hospital with serious wounds. On Saturday, September 28, 2013, the Butte County Sheriff's Department received a 9-1-1 call at 10:23 p.m., from an adult male who claimed he had just shot someone in self defense. A separate 9-1-1 call was transferred to the Sheriff's Department from the Gridley-Biggs Police Department from a male subject who told dispatchers that he and another male adult subject had been shot on Alexander Road near East Evans Reimer Road. Upon arrival, deputies found Eric Waller and his nephew, Chase Waller who had both been shot in the back. Both men were treated at the scene and transported to Enloe Medical Center where they remained at press time Wednesday. A short time later, deputies located Garrett Rudd, 24, of Gridley near the scene at River Avenue who was detained without incident. Deputies recovered the firearm used along with several magazines of ammunition in his vehicle. Garner requested that bail stipulations of no weapons and no contact with the victims be included on record along with an 8 p.m., curfew. Further arraignment is set for October 17, 2013.
