  • Judge sentences one year in jail for hit and run.

  • Butte County Superior Court Judge James Reilly sentenced 72-year-old Anton Mardesich to one year in Butte County Jail for the November 14,  2012 hit and run collision that resulted in the death of Rick Magee, 61 of Durham.
    Magee was riding his bicycle along the Midway in Durham when Mardesich struck him from behind in a 2007 Ford Edge. Mardesich left the scene of the accident and turned himself in on November 27 to the Chico CHP office after it was reported by a mobile windshield repairman at RT's Auto Body Shop that he found  human hair in the windshield.
    Mardesich was also given five years probation and cannot drive a motor vehicle during this time. He was ordered to pay fines and fees totaling more than $50,000 and will appear in March to determine the amount of restitution to be paid to Magee's family. He is to fulfill 1,000 hours of community service as part of his sentencing.
    Although Butte County's Probation Department recommended six months jail, Judge Reilly sentenced Mardesich to one year for the fatal collision and insurance fraud committed when he told his insurance company damage to the car had been caused by an oak branch. He pled guilty on December 5, 2012.
